Status as a real estate credit intermediary

Financial North Real Estate Capital Experts, S.L. is registered with the Register of Real Estate Credit Intermediaries and Real Estate Lenders of the Banco de España (Bank of Spain), pursuant to Law 5/2019, of 15 March, on real estate credit contracts (“LCCI”), under registration number E595. The supervisory authority is the Banco de España.
For the purposes of Article 4.7 of the LCCI, Financial North acts as a non-tied real estate credit intermediary.
In accordance with Article 30 of the LCCI, Financial North holds professional civil liability insurance taken out with Lloyd’s Insurance Company, S.A., policy number BASWZ1770653724250, covering damages arising from the performance of its intermediation activity.

Nature of the services provided
Financial North’s activity consists of the intermediation and structuring of real estate credit transactions within the meaning of Article 4.5 of the LCCI. Financial North does not provide advisory services within the meaning of Article 4.20 of the LCCI, and does not use the designations “independent advisory” or “independent advisor”, which are reserved by Article 19.6 of that Law.

Customer Service and complaints
In accordance with Order ECC/2502/2012 and the rules on transparency and protection of banking customers, Financial North operates a Customer Service Department to which Users may direct enquiries, complaints and claims, at the following address: reclamaciones@financialnorth.com. Once two months have elapsed from the submission of a complaint to the Customer Service Department without a response, or if the response is unsatisfactory, the claimant may apply to the Complaints Service of the Banco de España (calle Alcalá 48, 28014 Madrid), in accordance with the procedure provided for in its rules.

2. DEFINITIONS
Among other terms, the following are used:
“Website”: the domain or domains made available to the Internet User.
“User”: a natural person who uses or browses the Website.
“Contents”: the pages comprising the entirety of the domain, which contain the information and services that the Owner makes available to the Internet User. They include messages, texts, photographs, graphics, icons, logos, technology, links, textures, drawings, sound and/or image files, recordings, software, look and feel, graphic design and source code, and in general any kind of material contained in the Website.

Financial North Real Estate Capital Experts, S.L. does not guarantee uninterrupted or error-free access, although it will implement technical measures to prevent disruptions.
Financial North Real Estate Capital Experts, S.L. does not warrant that the website or its contents will be free from interruptions or errors, nor that the contents are up to date, but it will use its best efforts to prevent, remedy or update them where appropriate. It therefore accepts no liability for any damages or losses suffered by the User as a result of failures or disconnections in telecommunications networks causing the suspension, cancellation or interruption of the website service, whether during the provision of the service or beforehand.
The Owner excludes, save for the exceptions provided for under applicable legislation, any liability for damages and losses of any kind that may result from the lack of availability, continuity or quality of the operation of the website or the contents, or from the failure to meet any expectation of usefulness that the User may have attributed to them.
Access to the website does not entail any obligation on the part of the Owner to monitor for the absence of viruses, worms or any other harmful computer element. It is the User’s responsibility to have appropriate tools for detecting and removing harmful software. Accordingly, Financial North Real Estate Capital Experts, S.L. accepts no liability for any security failures that may occur during the provision of the website service, nor for any damage that may be caused to the User’s or third parties’ IT systems (hardware and software), or to the files or documents stored therein, as a result of the presence of viruses on the User’s computer used to connect to the services and contents of the Website, the malfunctioning of the browser, or the use of out-of-date versions of it.

7. REPRODUCTION OF CONTENTS
Save for the situations covered by applicable intellectual property legislation, in particular the right of quotation and the other lawful uses provided for under the Consolidated Text of the Spanish Intellectual Property Act (Royal Legislative Decree 1/1996), the User undertakes not to reproduce, distribute, publicly communicate, transform or commercially exploit, in whole or in part, the contents of the website without the prior, express and written authorisation of the holder of the corresponding rights.
Likewise, in line with the foregoing, the User may not:

12. LIMITATION OF LIABILITY
Financial North Real Estate Capital Experts, S.L. excludes all liability for the decisions that the User may make on the basis of this information, as well as for any typographical errors that the documents and graphics on the Website may contain. The information is subject to periodic changes without prior notice as a result of expansion, improvement, correction or updating of the Contents.
The Owner is not liable for the accuracy of any information that is not produced by it and for which a different source is indicated, and accordingly assumes no liability for any hypothetical losses that may arise from the use of such information. The Owner reserves the right to update, modify or remove the information contained on its web pages, and may even limit or refuse access to such information. The Owner is exempt from liability for any damage or loss that the User may suffer as a result of errors, defects or omissions in the information provided by the Owner, provided that such information comes from external sources.

13. PARTIAL NULLITY
If any of these general conditions is contrary to the law and is therefore invalid, this shall not affect the validity of the remaining provisions, which shall remain in full force and effect. In such a case, the parties undertake to renegotiate in good faith the affected clause or condition, with a view to replacing it with another that reflects, as far as possible, the original purpose and is in accordance with the law, integrating it into the rest of the agreement without altering its overall balance.

14. JURISDICTION
For any matters that may arise in connection with the interpretation, application and performance of this Legal Notice, as well as in respect of any claims that may derive from its use, all parties expressly submit to the jurisdiction of the Courts of Santa Cruz de Tenerife, expressly waiving any other jurisdiction that may correspond to them, without prejudice to any forums that may legally correspond to Users qualifying as consumers.

This Legal Notice is governed by Spanish law.
All copyrights are reserved in accordance with the laws and international treaties on intellectual property. The copying, reproduction, distribution or dissemination, in whole or in part, of the contents by any means is expressly prohibited without the prior and express authorisation of the Owner.
